Equip for Equality Hosts Disability Rights Consortium Meeting on June 24th -- Focusing on Using the ADA/Section 504 in Education Cases.

The next meeting of the Disability Rights Consortium will take place on Wednesday, June 24th from 9:30-11:00 at Equip for Equality (20 N. Michigan Ave., Suite 300, Chicago, IL).


Topic: Professor Weber's presentation "The ADA in the Classroom: Of Reasonable Accommodations and Gross Misjudgments" will discuss recent research casting doubt on the widespread belief by judges that in ADA Title II and Section 504 cases about failure to provide reasonable modifications for students with disabilities, plaintiffs have to show the school engaged in intentional wrongdoing, that is, acting with deliberate indifference, bad faith, or gross misjudgment. The presentation will take up authorities from the Supreme Court and other sources that support awarding a full range of remedies-including compensatory damages, where appropriate-when schools and other entities violate Section 504 and the Title II of the ADA, even when they act without any discriminatory animus.
