Topic: The Illinois Mental Health Code: Safeguard or Mirage? This program aims to demystify the opaque processes at the core of the Mental Health Code for matters involving petitions for involuntary commitment and forced treatment of recipients living with serious mental illnesses. The presentation will highlight the key legal mechanics of such civil proceedings, which are designed to respect a person's autonomy and protect fundamental liberty interests. It will then contrast these legislative protections with notable court decisions that have degraded or otherwise undermined the same safeguards. Ultimately, attendees will have a clearer understanding of the legal framework for these critical proceedings and how courts have interpreted central provisions to shape everyday practice.
